Terms of Service for Lumière Beauty Studio

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services, website, booking channels, communications, and related offerings provided by Lumière Beauty Studio (“Lumière Beauty Studio,” “we,” “us,” or “our”), a makeup-studio business located in Toronto, Ontario, Canada.
By booking, purchasing, requesting, or using any service offered by Lumière Beauty Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
These Terms apply to all clients, customers, guests, and any person acting on behalf of a client. If you are booking services for another person, you represent that you have authority to accept these Terms on that person’s behalf.
2. Scope of Services
Lumière Beauty Studio provides professional makeup and related beauty services, which may include, without limitation:
- Bridal makeup application
- Event and special occasion makeup
- Editorial and photoshoot makeup
- Makeup lessons and personal consultations
- Airbrush makeup application
- On-location makeup services
Service availability may vary depending on scheduling, staffing, location, product availability, and other operational considerations. We reserve the right to refuse, modify, or discontinue any service request at our discretion, subject to applicable law.
Any service descriptions, timing estimates, or recommendations provided by Lumière Beauty Studio are intended for general informational purposes only and do not constitute a guarantee of a particular result.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, complete, and current information when booking or communicating with us;
- Disclose any allergies, skin sensitivities, medical conditions, recent cosmetic procedures, or other relevant health concerns before your appointment;
- Follow all pre-appointment instructions, including arriving with a clean face when requested and avoiding products or treatments that may affect service results;
- Ensure that any minors receiving services are accompanied by a parent or legal guardian, where required;
- Behave respectfully toward our staff, contractors, and other clients;
- Provide a safe, sanitary, and suitable environment for on-location services, including adequate lighting, seating, and workspace;
- Comply with all applicable laws, venue rules, and safety requirements.
You are solely responsible for informing us of any known or suspected allergies or adverse reactions to cosmetics, adhesives, sanitizers, tools, or other products used in connection with our services. While we may use professional-grade products and reasonable hygiene practices, we cannot guarantee that a reaction will not occur.
We reserve the right to decline service if, in our reasonable judgment, a client’s conduct, hygiene, intoxication, illness, or other circumstances create a safety, health, or operational concern.
4. Payment Terms and Conditions
All prices are listed in Canadian dollars unless otherwise stated. Prices may vary based on service type, complexity, travel, timing, group size, and special requests.
Unless otherwise agreed in writing, payment terms are as follows:
- A deposit or retainer may be required to secure a booking;
- The remaining balance, if any, is due on or before the appointment date;
- Accepted payment methods may include cash, debit, credit card, e-transfer, or other methods communicated by Lumière Beauty Studio;
- Any applicable taxes, fees, travel charges, parking fees, tolls, or venue-related costs may be added to the final invoice.
Deposits and retainers are generally non-refundable unless otherwise required by applicable law or expressly stated in writing by Lumière Beauty Studio. A booking is not confirmed until the required deposit, retainer, or full payment has been received and cleared.
If payment is declined, reversed, disputed, or otherwise not received, we may suspend or cancel the booking and seek recovery of any outstanding amounts, including reasonable collection costs permitted by law.
Late payments may be subject to administrative fees or interest to the extent permitted by applicable law and disclosed in advance.
5. Cancellation and Refund Policy
We understand that plans may change. Cancellations and rescheduling requests are subject to our availability and the following policy, unless a different policy is provided in writing for a specific booking:
- Cancellations made with sufficient notice may be eligible for rescheduling, subject to availability;
- Late cancellations, no-shows, or cancellations made within a short notice period may result in forfeiture of the deposit or retainer;
- Group bookings, bridal bookings, on-location services, and peak-date reservations may be subject to stricter cancellation terms;
- Refunds, if any, are issued at our discretion and in accordance with applicable consumer protection laws.
If Lumière Beauty Studio must cancel or reschedule due to illness, emergency, safety concerns, force majeure, or other circumstances beyond our reasonable control, we will make reasonable efforts to offer an alternative date or refund amounts paid for services not rendered, as required by law and subject to any non-refundable third-party costs already incurred.
We are not responsible for refunds of third-party expenses, including venue fees, travel arrangements, accommodations, or other costs you may incur in connection with a booking.
6. Liability Limitations
To the fullest extent permitted by applicable law, Lumière Beauty Studio, including its owners, employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the use of our services.
Without limiting the foregoing, we are not responsible for:
- Allergic reactions, skin irritation, breakouts, or other adverse effects, except to the extent caused by our gross negligence or willful misconduct where liability cannot be excluded by law;
- Damage to clothing, accessories, or personal property unless caused by our proven negligence;
- Delays, interruptions, or service limitations caused by traffic, weather, venue restrictions, client lateness, or other factors outside our control;
- Outcomes that differ from a client’s subjective expectations, including color appearance, longevity, or photographic results;
- Issues arising from inaccurate information provided by the client or from the client’s failure to follow pre- or post-service instructions.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, gross negligence, or other non-excludable obligations under Canadian law.
Where liability cannot be excluded, our total aggregate liability for any claim arising from or relating to a specific service shall be limited to the amount paid by you for that service, to the extent permitted by law.
7. Intellectual Property Rights
All content created, owned, or licensed by Lumière Beauty Studio, including but not limited to text, branding, logos, service descriptions, images, photographs, videos, graphics, and website materials, is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, publish, display, or create derivative works from our intellectual property without our prior written consent, except as permitted by law.
Any makeup looks, techniques, or consultation materials provided during a service remain our intellectual property unless otherwise agreed in writing. You may use personal photos taken during or after services for private, non-commercial purposes, provided such use does not misrepresent our brand or imply endorsement.
If we photograph, film, or otherwise capture your service results, you grant Lumière Beauty Studio a non-exclusive, worldwide, royalty-free license to use such content for portfolio, marketing, training, social media, and promotional purposes, unless you notify us in writing before the appointment that you do not consent. Any such use will be subject to applicable privacy laws and any consent requirements under Canadian law.
8. Data Protection and Privacy
Lumière Beauty Studio is committed to protecting personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.
We may collect, use, disclose, and retain personal information necessary to:
- Process bookings and payments;
- Communicate with you about appointments and services;
- Maintain client records and service preferences;
- Address allergies, sensitivities, and safety concerns;
- Comply with legal, tax, accounting, and regulatory obligations;
- Improve our services and customer experience.

9. Force Majeure
Lumière Beauty Studio shall not be liable for any delay, failure, or inability to perform any obligation under these Terms where such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flood, power outages, labour disputes, illness, epidemic or pandemic events, government restrictions, transportation disruptions, venue closures, or supply shortages.
In the event of force majeure, we may reschedule, modify, or cancel affected services without liability except as otherwise required by applicable law.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The updated Terms will be posted or otherwise made available to you and will be effective on the date stated in the revised version, unless a later date is specified.
Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services.
11. Applicable Law and Jurisdiction
These Terms, and any dispute, claim, or controversy arising out of or relating to them or to our services, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or our services, subject to any mandatory consumer protection rights or other non-waivable rights under applicable law.

13. Severability Clause
